The management scheme for registered price engineers, which was discussed at the 112th general meeting of the ministry of construction on 11 december 2006, has been published and is in effect since 1 march 2007。

Administration of registered price engineers
Chapter i general provisions
In order to strengthen the management of registered price engineers, to regulate the practice of registered price engineers and to safeguard the public interest, this approach was developed。
Article ii. This approach applies to the registration, practice, continuing education and supervision of registered price engineers in the people's republic of china。
Thirdly, for the purposes of this scheme, registered price engineers are professionals who have obtained the qualifications of the people's republic of china for the practice of price engineers (hereinafter referred to as " practice qualification " ) through a national uniform qualification examination or certification, mutual recognition of qualifications, registration under this scheme, a certificate of registration of price engineers from the people's republic of china (hereinafter referred to as " certificate of registration " ) and a stamp of practice for the exercise of engineering price activities。
A person who has not obtained a certificate of registration and a stamp of practice may not engage in price-making activities on behalf of a registered price engineer。
Article iv. The state council's construction authority exercises unified supervision over the registration and practice of registered price engineers throughout the country; the relevant departments of the state council, such as railways, transport, water and information industries, are subject to a division of responsibilities established by the state council, and supervision over the registration and practice of registered price engineers。
The people's government-building authorities of the provinces, autonomous regions and municipalities directly under the central government exercise supervision over the registration and practice of registered price engineers in their administrative regions。
Article v. The organization of engineering price industries should strengthen the self-regulation of price engineers。
Registered price engineers are encouraged to join the engineering price industry organization。
Notes
Article vi. Registered price engineers operate a system of registered practice。
Persons who are qualified to practice may do so under the name of registered price engineers。
Article 7 conditions for registration of registered price engineers are:
(i) to qualify for practice
(ii) be employed in a consulting engineering firm or in construction, survey design, construction, solicitation agency, engineering supervision, construction price management, etc.
(iii) in the absence of article 12 of this scheme, not to register。
Article 8. Persons who have obtained qualifications to practise their profession shall apply for registration to the provincial, autonomous or municipal people's government-building authority where the employer is registered (hereinafter referred to as the provincial register of first instance) or to the relevant department of the state council (hereinafter referred to as the departmental register of first instance)。
If the application is initially registered, the registered first instance authority shall examine it within 20 days of the date of receipt of the application and submit the application and the preliminary opinion to the state council's construction authority (hereinafter referred to as the registered authority). The registered authority shall decide within 20 days of the date of admissibility。
If the application for a change of registration is renewed, the registered first instance authority shall examine it within five days of the date of receipt of the application and shall submit the application and the preliminary opinion to the registered authority. The registered authority shall decide within 10 days of the date of admissibility。
Initial, change, renewal of registration of registered price engineers, gradual implementation of online filing, processing and approval。
Article 9 a person who has obtained a certificate of qualification may apply for the initial registration within one year of the date of issue of the certificate of qualification. In order to apply for initial registration, the overdue applicant must meet the requirements for continuing education. Initial registration is valid for four years。
When applying for initial registration, the following information shall be submitted:
(i) initial registration application form
(ii) a copy of the certificate of qualification and identity
(iii) a copy of the employment contract with the employer
(iv) proof of work for the construction of a paid job
(v) a person who has obtained a certificate of qualification who has applied for initial registration one year after the date of issuance of the certificate shall be provided with a certificate of continuing education
(vi) an intermediary qualified for consulting on engineering shall provide a social basic pension insurance certificate, a copy of the contract of the personnel agent to which the employer has contributed, or a copy of the certificate of separation issued by the labour or personnel services
(vii) foreign nationals and people of taiwan shall provide a copy of an employment permit for foreigners and of an employment certificate for people of taiwan。
Article 10 if a registered price engineer is required to continue his or her practice after the effective date of registration, he or she shall apply for a renewal of registration in accordance with the procedure set out in article 8 of this scheme until 30 years after the effective date of registration. Continued registration is valid for four years。
If the application is for continued registration, the following information shall be submitted:
(i) continuation of the registration application form
(ii) certificate of registration
(iii) a copy of the employment contract with the employer
(iv) certification of performance during the previous registration period
(v) certificate of continuing education。
Article 11 if, during the period of registration, the registered price engineer changes his/her practice, he/she shall terminate his/her employment contract with the original employer and proceed with the change of registration in accordance with the procedure laid down in article 8 of this act. The period of validity of the change of registration is renewed。
When applying for a change of registration, the following information shall be submitted:
(i) change of registration application form
(ii) certificate of registration
(iii) a copy of the labour contract signed with the new employer
(iv) proof of termination of employment contract with the original employer
(v) an intermediary qualified for consulting engineering shall provide a social basic pension insurance certificate, a copy of the contract of the personnel agent to which the employer has contributed, or a copy of the certificate of separation issued by the labour or personnel services
(vi) foreigners and people of taiwan must provide copies of their employment permits and certificates of employment for people of taiwan。
Article 12 failure to register:
(i) does not have full civil capacity
(ii) the application is registered in two or more units
(iii) failure to meet the standard for continuing education of priced engineers
(iv) if the performance of the work during the previous registration period fails to meet the required standards or if the performance of the work is suspended and the work is discharged from the construction-priced business position
(v) criminal penalties which have not been completed
(vi) if criminal penalties are imposed for work-price operations, from the date of the execution of the criminal penalty until the date of the application for registration, less than five years
(vii) be liable to a criminal penalty for reasons other than those set forth in the preceding paragraph, for a period of less than three years from the date of the decision to punish to the date of the application for registration
(viii) has been revoked from the date of the decision to punish and less than three years from the date of application for registration
(ix) if the registration has been revoked by improper means such as deception or bribery and less than three years from the date of withdrawal of registration to the date of application for registration
(x) other cases where the law or regulation provides for non-registration。
Article 13. A person who has been deregistered or disregistered shall be subject to the procedure laid down in article 8, paragraphs 1 and 2, of this scheme if he or she re-apply for registration after the conditions for registration have been met。
Article 14 if registration is granted, the registration certificate and the professional seal are issued by the registered authority。
The certificate of registration and the certificate of practice are the certificates of practice of the registered price engineer and should be kept and used by the registered price engineer himself。
The registration certificate of the price engineer is printed by the registered authority。
The loss of the registered price engineer's certificate of registration, professional seal shall be followed by an application for re-issuance in accordance with the procedure set out in article 8, paragraphs 1 and 3, of this scheme after the public media has declared it null and void。
Chapter iii
Article 15: registered price engineers who practice:
(i) preparation and audit of construction project proposals, feasibility study investment estimates, project economic evaluation, preparation and audit of engineering, pre-positioning, settlement, completion (decision) calculations
(ii) a list of the volume of work, the floor (or controlled price), the preparation and approval of bid quotations, the conclusion and modification of the contract price for the works, adjustments, payment for the works and calculation of the costs claimed for the works
(iii) optimization of the design programme in the construction project management process, price analysis and control of works such as cap design, and verification of engineering insurance claims
(iv) identification of economic disputes in engineering。
Article 16 registered price engineers have the following rights:
(i) use of the names of registered price engineers
(ii) carrying out independently, in accordance with the law, the pricing of works
(iii) signing and sealing of the outcome document on the pricing of works resulting from my practice
(iv) initiate the establishment of a consulting enterprise for the construction of the works
(v) keep and use their own certificates of registration and professional seals
(vi) participation in continuing education。
Article 17. Registered price engineers shall perform the following duties:
(i) comply with laws, regulations, regulations and professional ethics
(ii) quality assurance of the results of practice activities
(iii) access to continuing education and higher levels of practice
(iv) implementation of engineering pricing standards and valuation methods
(v) if he or she has an interest in the parties, recuse himself or herself
(vi) state secrets and the commercial and technical secrets of others as known in practice。
Article 18: registered price engineers should sign and stamp the outcome document on the price of the works they undertake。
Article 19 the amendment of the price-fixing outcome document signed by the registered price-fixing engineer should be done by the registered price-separating engineer himself; if the registered price-fixing engineer is unable to make the modification himself due to exceptional circumstances, it should be amended and stamped by other registered price-fixing engineers; and the registered price-fixing engineer who modified the price-fixing document of the project should bear the corresponding legal liability for the modification。
Article 20. Registered price engineers shall not:
(i) failure to fulfil the obligation to register price engineers
(ii) the solicitation of bribes, bribes or other benefits in addition to contractual costs in the course of the practice
(iii) commercial bribery in practice
(iv) signing of a price outcome document with falsely documented and misleading statements
(v) personally undertaking the construction-price business
(vi) allowing others to engage in construction-price operations in their own name
(vii) practiced simultaneously in two or more units
(viii) the alteration, re-sale, lease, loan or other form of illicit transfer of a certificate of registration or a stamp of practice
(ix) other acts prohibited by law, regulation or regulation。
Article 21 if, during the period of registration, a registered price engineer is required to suspend his or her practice for special reasons, he or she shall appear before the registered first instance authority for suspension and return his or her certificate of registration and seal of practice。
Article 22: registered price engineers shall meet the continuing education requirements established by the registrar during each registration period。
The continuing education of registered price engineers is divided into compulsory and optional courses, each of which is valid for 60 school hours. Certificates of continuing education are issued after continuing education meets the eligibility criteria。
The continuing education of registered price engineers is organized by the china association for price management of construction works。
Chapter iv oversight and management
Article 23. The authorities responsible for building people's governments at the county level and above, and other relevant authorities, shall supervise the registration, practice and continuing education of registered price engineers, in accordance with the relevant laws, regulations and practices。
Article 24 the registering authority shall inform the registering authority of the registration of the price engineer。
The provincial register of first instance authorities shall inform the city and county people's government building authorities of the registration of price engineers in the administrative district。
Article 25. The authorities responsible for building the people's government at the county level and above and other relevant authorities, in accordance with the law, shall have the right to take the following measures in the exercise of their supervisory and inspection responsibilities:
(i) require the inspected person to have a certificate of registration
(ii) require the employer where the person is hired to provide the outcome document of the construction price signed by the person concerned and the related business files
(iii) inquiries with those who sign the project price outcome document on the relevant issues
(iv) redress violations of the relevant laws, regulations and methods, as well as the pricing criteria and methods of valuation for works。
Article 26. The authorities responsible for building local people's governments at the district level and above, or other relevant authorities, where the offence has been committed, shall investigate and prosecute it in accordance with the law and shall inform the registered authorities of the facts of the violation and of the outcome of the proceedings; the authorities responsible for building local people's governments at the district level and above where the offence has been committed, or other competent authorities, shall inform the registered authorities of the violation of the law, the recommendations for processing and related materials。
Article 27 a registered price engineer whose certificate of registration expires:
(i) has terminated the employment contract with the employer and has not been engaged by another employer
(ii) when the registration has expired and has not been renewed
(iii) death or incomplete civil capacity
(iv) other circumstances leading to the lapse of registration。
Article 28 the registration of a registered price engineer may be revoked by the registering authority or its superior administrative authority, acting ex officio or at the request of an interested party, if:
(i) abuse of authority and negligence of administrative staff in granting registration permits
(ii) a licence to register has been granted beyond the statutory authority
(iii) a licence to register is granted in violation of the procedure established by law
(iv) the granting of registration permits to applicants who do not have the conditions for registration
(v) other circumstances in which registration may be withdrawn by law。
Where the applicant is improperly registered by deception, bribery, etc., it should be withdrawn。
Article 29 if the registration authority cancels the registration, revokes the certificate of registration and the certificate of practice or announces that the certificate of registration and the seal of practice have been cancelled:
(a) in the circumstances set forth in article 27 of this approach
(ii) has been deregistered in accordance with the law
(iii) if the registration certificate has been revoked in accordance with the law
(iv) be criminally punished
(v) other circumstances in which the law or regulation provides for the cancellation of registration。
If the registered price engineer has one of the circumstances listed in the preceding paragraph, the registered price engineer himself and the employer shall submit a timely request for cancellation to the registration authority; the relevant units and individuals shall have the right to report to the registration authority; the local people's government building authority or other relevant authority above the county level shall inform the registration authority promptly。
Article 30. Registered price engineers and their employing units shall provide the registrar with true, accurate and complete information on the credit files of registered price engineers, in accordance with the relevant provisions。
The credit files of registered price engineers should include the basic profile of price engineers, performance, good behaviour, bad behaviour, etc. Cases of irregularity, handling of complaints and administrative sanctions should be recorded in the credit files as misconduct by price engineers。
Information on the credit files of registered price engineers is made public in accordance with the relevant provisions。
