    Notification on issues related to the simplification of procedures to facilitate the use of specialized residential maintenance funds in emergency situations

    District housing urban and rural construction committees (hurccs), east and west city housing and urban construction committees, economic technology development district premises directorate, district and district department of municipal housing finance management centres, relevant units and relevant owners:

    In order to ensure the timely maintenance of property shares and facilities in the six emergency situations under article 34 of the beijing municipal property management scheme (city government decree no. 219) in the area of property management, and in accordance with the principles of “ensuring safety, clarifying responsibilities, reducing intersections, regulating procedures, facilitating access and enforcing legal accountability”, in accordance with the provisions of the property act, the housing special maintenance funds management scheme (ministry of construction, ministry of finance decree no. 165), the beijing municipal property management scheme and the beijing municipal housing special maintenance facility (kyoto building property no. 836), the following information is provided on issues related to the emergency use of funds for special residential repairs in our city:

    I. Where emergency maintenance requires the use of specialized residential maintenance funds, the consent of the owner or owners of more than two thirds of the total building area and of more than two thirds of the total is not required to be covered by the dedicated residential maintenance fund, but the owner's committee shall inform the owner, at a prominent location within the property management area, of the specific maintenance funds used for emergency maintenance; there is no owner's committee, and this is done by the property service enterprise。

    (ii) if emergency maintenance requires the use of special maintenance funds for residential goods, maintenance funds that have not yet been transferred to a special account of the proprietors ' assembly, an application shall be submitted by the proprietary services enterprise to the district construction board or the management of property management or housing safety administration of the district property commission or the housing management authority (see annex 1 for a specific address); if the maintenance funds have been transferred to a special account of the proprietary assembly, the proprietors ' committee shall apply to the district construction commission or the management of property or housing security administration of the housing authority; if the proprietors are unwilling to apply, the proprietors ' committee has expired and the new term of office of the proprietors ' committee has not been completed, or has been abandoned by the proprietors ' committee, an application shall be submitted by the proprietor to the district construction board or the management of housing security of the district of the district of the proprieture; the owners concerned are the owners of the houses involved in the six emergency situations that endanger the safety of the use of the houses, as stipulated in article 34 of the beijing municipal property management scheme. In the event of non-compliance with the applicant's responsibilities by an owner's board or property service enterprise, the relevant liability is subsequently established by law. In case of emergency repairs and maintenance using the funds for the specialized maintenance of publicly owned dwellings sold by the municipal system units, the original housing unit is notified by the property service provider or the owner concerned that the application is made to the district construction board or the housing authority of the municipality in which the property is located (see annex 2 for a specific address); the sale of the housing and maintenance funds are recorded in the name of the property service enterprise and are applied by the property service enterprise; the property service enterprise is applied by the entity that is unwilling to apply for or unable to find the original housing unit for the relocation of the dwelling; and the parent of the publicly owned housing unit has applied for the loss, and the higher authority is reluctant to apply or has no authority to apply for it. In cases where the original public housing unit, property service enterprise does not apply for emergency maintenance as required, the owner submits an application for replacement to the district construction commission or the housing rehabilitation department of the housing authority, where the property is located.     Procedures relating to funds for emergency maintenance and specialized residential maintenance

    (i) the application and submission of the following information by the owner's board, the property service enterprise, the original place of sale of publicly owned housing or its superiors:

    1. A completed application form for a special maintenance fund for the emergency maintenance of residential housing for the use of commodities or for a special maintenance fund for residential housing for public housing after the sale of such housing for emergency maintenance (see annex 4)

    2. If the construction unit selected is not on the list of construction enterprises for emergency maintenance in the city (see annex 8), a licence, a copy of the certificate of qualification and a copy thereof shall be submitted

    3. The budget for emergency maintenance works

    4. Detailed cost-sharing tables for specialized residential maintenance (see annex 5). The district audit authorities may not, without permission, request the applicant to submit other materials as an element for the application of funds for the emergency use of residential maintenance。

    (ii) the application is in conformity with the requirement that the district construction commission or the housing authority take a decision on consent within two working days of receipt of the application; if the circumstances are particularly urgent, the decision on consent shall be taken in situ. Cases where the district commissions or the housing authority have discovered an overstatement of the scope of maintenance and the budget for the works shall be subject to rigorous investigation in accordance with the law.     (iii) in cases where funds for specialized residential maintenance have not been transferred to a special account of the general conference of the owners, the request for special maintenance funds for emergency maintenance of residential housing using goods, application forms for special maintenance funds for public housing after use in emergency maintenance and a breakdown of the share of special maintenance funds for residential housing with a stamp of the approved department is processed by the applicant by the district department of the municipal housing funds management centre (see annex 7 for specific address); in cases where special maintenance funds have been transferred to a special account of the general conference of the owners, the request for special maintenance funds for which the district construction board or the housing authority has agreed to file for payment by the opening bank of the conference of the owners. Within two working days from the date of receipt of the advisory opinion of the district construction commission or the housing authority on the use of the said funds, the bank shall cooperate in the timely transfer of the funds for maintenance to the designated account of the property service enterprise, the landlord's committee or the application unit for the use of the funds for the exclusive maintenance of publicly owned housing houses; in the event of a special emergency, the district management department of the municipal housing funds management centre, the bank operating the account shall do so within 24 hours from the date of receipt of the advisory opinion of the district construction commission or the housing authority. In the event of a problem with the processing of materials or a failure to pay for them, the district department of the municipal housing finance management centre shall notify the original approving department and the applicant in a timely manner that the relevant materials are promptly completed。

    6. Upon completion of the emergency maintenance works, the construction enterprise shall report in writing to the owners ' committee, the property services enterprise, the original public housing unit or its superiors. The owner's committee (who does not have an owner's assembly) who applies for the emergency use of special housing maintenance funds (whose representatives may be convened by the community housing committee), the property service enterprise, the public housing sales unit or its superiors shall organize the receipt and inspection of the project, issue the report of the acceptance and make an opinion on its eligibility within five working days; if it is not qualified, the construction enterprise shall undergo an unconditional change to a satisfactory condition. Upon completion of the work, the construction enterprise shall report to the district commission or the housing authority that the district commission or the housing authority shall give an opinion within five working days as to whether it is eligible; if it is not, the construction enterprise shall be changed to a qualified project without conditions. Consent is deemed to have been given if the owner's board, the property service enterprise, the public housing unit or its parent unit, the district council or the housing authority have not given their opinion within the prescribed time limit. The construction enterprise performing the emergency repairs should assume the quality assurance responsibility for the maintenance works performed, and the quality problems during the warranty period should be repaired in a timely manner. The construction enterprise may take insurance coverage for the maintenance work performed by it, and the cost of repairing the damage as a result of quality problems is covered by the insurance company。

    In order to facilitate the selection of construction enterprises by the entities concerned and the owners concerned, on the basis of the voluntary registration of the enterprises, and subject to verification by the municipal, district and municipal housing construction administration, the municipality has established, in conjunction with the social evaluation, a list of emergency maintenance construction enterprises with good credit and construction capacity (see annex 8), for the selection of the units in need and the relevant owners. When emergency repairs are required, the owner's board, the property service enterprise, the public housing unit or its parent unit, the district council or the housing authority may, on their own initiative, select the construction enterprise in the above-mentioned list of construction units by means of a tender, competitive negotiation, roll call, etc., or, in accordance with the relevant provisions, by means of a tender, the construction enterprise that is not qualified in the list. The emergency maintenance and construction business directory is dynamically managed.     9. The staff of the district commissions or the housing authority shall not place obstacles in the way of applicants and shall not deliberately delay the time limit for processing applications for funds for the emergency use of housing. The department of district and district administration of the municipal housing funds management centre shall complete the payment of the funds within a specified time frame, without undue delay, upon receipt of a reply from the district and district commissions or the housing administrations agreeing to use the funds for maintenance. Acts of omission and misconduct by administrative staff are promptly and seriously investigated by district commissions or housing authorities, and by the district department of municipal housing funds management centres。

    Upon completion of the emergency maintenance works, the owner's committee, the property service company or the unit of maintenance of other organizations shall inform the owner of the significant location in the property management area of the total amount of funds spent on the specialized maintenance of the works and the owner's share, and the organizational unit shall provide a clear written response to the question。

    11. Property service enterprises and housing management units shall, within 20 days from the date of this circular, conduct an inventory of houses and shared areas, shared facility equipment and establish emergency maintenance desk accounts in the area under their administration. The district department of municipal housing funds management, in cooperation with the property services enterprise and the housing management unit, shall establish a maintenance fund account in the property management area for a period of three months to register the name of the owner, the size of the house, the balance of the maintenance fund, and to establish clear property rights and an accurate breakdown of the amount of funds for maintenance。

    12. The use of funds for the exclusive maintenance of publicly owned dwellings (including workers ' homes) sold by the central state bodies in kyoto and by the direct authorities of the central government of the ccp in kyoto (including workers ' homes) in connection with the sale of publicly owned housing in the same property management area is the use of houses that intersect with the sale of commercial dwellings and municipal housing units。

    13.
