The new deal
The tax is paid for the gift of property, first and foremost, and if the child is the heir to the property, the tax is not payable, but it must be paid in comparison with the form of transfer chosen for sale or gift. There are also notary fees, and finally stamp duties and assessment fees, which are taxes on the transfer of the house to the children。
Ii. What formalities are required for the transfer of property to children
1. When the real estate title certificate changes without a real estate broker, the agreement of the parties and the breach of contract must be clearly written in the contract, the owner of the property on the seller's property certificate must be present at the time of signing the contract of sale and, if married, both spouses must be present and sign in order to be valid, even if there is only one name on the property certificate to know whether the other is married or not。
Once all the materials required for the application have been prepared, the required forms and an inventory contract can be completed at the housing authority of the local district, and the amount must correspond to the amount of the contract signed by the seller and buyer。
3. Once the application for change of title has been submitted to the housing authority in its entirety, the housing authority will issue a letter of return to the applicant, which will allow us to pay the tax according to the date stated in the letter of return, which will normally be about 15 working days. Once all the tax payments required for the transfer of the property have been paid, it will be possible to obtain the property certificate。
Iii. The process of granting property
Signature of confirmation
Before entering into the property grant process, the landlord and the grantees will need to sign a confirmation letter with the housing authority and bring the relevant information. Relevant information includes property titles, purchase contracts, gifts and acceptance of gifts. The two public certificates are to be issued simultaneously, indicating, on the one hand, the genuine will of the grantee, and, on the other hand, the genuine will of the grantee to accept the gift。
2. Real estate assessment
Once the relevant confirmations have been signed, it will be possible to wait until the housing authority has sent a professional property evaluator to carry out home mapping and then to await the results of the housing evaluation. The assessment generally includes the depreciation rate of the property, infrastructure, gas communications, the base price, the flat price, the replacement price, the floor price and the replacement price。
3. Processing gifts and notaries
While notarization may be granted in the course of the grant, the granting of a notarization is more insured for both owners and grantees. Information is required for the processing of gifts: identification card of the gifter, original and copies of the household register, the gift book, the list of gifts and proof of ownership。
4. Taxes and charges
In the course of the grant, the grantee is also required to pay taxes, including deed, stamp duty and registration fee, which amount to 3 per cent of the total value of the housing assessment, stamp duty to 0. 5 per cent of the total value of the assessment, and registration fee for transfer of property rights, which is based on the local housing authority price. However, tax exemption is granted if the grantee and the recipient are immediate family members. This is in addition to land concessions, depending on the nature of the property in which the property is granted。
5. Processing new properties evidence
The last step in the granting of property is the processing of new property certificates. There are also a number of points to be made here: first, that gifts are legal acts of a pro bono nature and that their legal consequences cannot be equated with paid assignments; and second, gifts, not succession, which are fundamentally different. Thirdly, the act of notarized gift cannot be revoked, so it must be considered before notarized. Once again, special attention is drawn to the need for caution and clarity in the procedures for property gifts。
A clear answer to the new deal's question as to whether a child is taxed by a property gift is that it must be taxed, while providing you with information about the process of making the gift, what the attention is, and what the care is。
