Assistance for intellectual property rights in the city of gyan stop
Management approach
Article 1 in accordance with the circular of the people's government of the city of gyan on the publication of the programme of action for the construction of the intellectual property power of gyan (2023-2035) (2023] in the spirit of document no. 54, and with a view to further implementing the national intellectual property strategy, accelerating the construction of a strong intellectual property market, improving the public service system, and promoting and regulating assistance and reporting of complaints on intellectual property rights in our city, the centre for the monitoring of markets of the city of gian has now developed the methodology for the management of its intellectual property rights assistance posts (hereinafter referred to as workstations)。
The second municipal market supervision authority is responsible for the integrated layout, macro-management and mentoring of workstations throughout the city. The day-to-day operation and management of local workstations is the responsibility of the market supervision authority in each county (city, district)。
The third municipal workstation is set up by the gian municipal market supervisory authority, with a high concentration of intellectual property demand, a high level of intellectual property activity, a basic market regulatory subdivision, priority parks (incubators), priority markets, priority business units and other traditional or innovative vehicles, to provide intellectual property protection and integrated services to enterprises and the public in the region。
In accordance with article iv, the market supervision authority of each county (municipality, district) may set up county-level workstations as required by its work。
The construction of the article 5 workstations is based on the principles of “city and county association, hierarchy, synergy”, which are set up and run in the form of recommendations for declaration, appraisal, two levels of nurturing, dynamic management。
The name, logo and image design of the article 6 workstation is set by the gian city market supervisory authority. The name of the workstation is generally “jian city intellectual property rights assistance station xx”. The logo of the workstation is generally composed of the text “jian city intellectual property rights assistance station xx” and the “institutional logo of the national intellectual property agency”。
Article 7 requires the following working conditions:
(i) the intellectual property authorities in the jurisdictions in which the workstations operate give high priority to intellectual property, ensuring that the workstations are supported through policy support, financial guidance, training of personnel, and that a focal point is in charge of directing the workstation coordination;
(ii) high priority given to intellectual property rights in the market monitoring subdivisions, priority parks (cubators), priority markets, priority enterprises, etc., where the workstations are located, and increased financial investment in the workstations, staffed by one or two part-time staff, to ensure the orderly operation of the workstations;
(iii) the head of the workstation should have a strong organizational coordination and management capacity, be familiar with relevant laws and regulations, policies and intellectual property advisory and information services in the area of intellectual property; and staff should be committed to the intellectual property cause, be conscientious and be accountable。
(iv) workstations have fixed office space, generally not less than 15 m2. Not less than two (sets) of computers with internet access and space; and office equipment such as networks, printers, photocopiers, etc., as required。
(v) workstations have uniform identification and image design. The installation of a single publicity logo, image wall, display and signboard。
(vi) workstations should have a well-defined portfolio of business services for intellectual property needs; they should be able to build long-term service relationships and continuously improve service capabilities to help innovative enterprises grow。
Basic duties of the article 8 workstation:
(i) training in intellectual property awareness. To take full advantage of the unique role of intellectual property protection in building a soft environment, such as training of personnel, advocacy and information exchange, and to promote regional and inter-industry intellectual property protection development and business collaborative exchanges through the organization of training in intellectual property awareness and advocacy, as well as the extensive promotion of intellectual property protection awareness and advocacy skills in the region and industry。
(ii) operational guidance for intellectual property work. The creation of a volunteer corps for intellectual property rights and assistance, with regular volunteer activities. Providing operational guidance on intellectual property access to information services, legal advice on intellectual property rights, intellectual property regulation, etc., for the workstations ' regions, industry clients, to help them solve practical problems; regularizing the collection of corporate intellectual property protection needs and difficulties, reporting to the city office, where appropriate, on the harmonization of research responses and optimizing policy measures。
(iii) assisting the intellectual property authorities of the bailiwick in their intellectual property protection and services. Workstations rely on industry practice experts to organize intellectual property dispute mediation; professional service providers to provide integrated, timely, professional and efficient intellectual property services to their regions, industry clients or member enterprises, to assist in upgrading the number and quality of patents for inventions in jurisdictions, and to actively promote the use of patent conversions such as pledge financing for intellectual property rights, patent insurance, patent product filing, co-operation with patent technology projects。
(iv) other intellectual property work assigned by the market regulator。
Article 9 of the market supervision authority of the city of gian provides dynamic management of workstations。
(i) workstations should actively work on intellectual property services, develop work plans at the beginning of the year, submit a year-round summary of their work to the municipal authorities by 20 december, and provide timely and accurate statistics, aggregates, and reports on work data and progress (including supporting information)。
(ii) the intellectual property management section of the municipal council is responsible for processing applications and evaluating applications for the establishment of municipal intellectual property support posts. The list is established and published by the municipal authorities in accordance with the procedure of voluntary declarations, first-instance recommendations of county offices, on-site expert evaluation, and publication of the city council website。
(iii) the intellectual property management section of the municipal bureau is responsible for the operational guidance, supervision and evaluation of workstations, and the day-to-day management of work is the responsibility of the market supervision office of the municipality (municipality, district) where the workstations are located。
(iv) workstations should establish sound management systems, clarify job responsibilities and ensure orderly work. Workstations should identify a contact person for working contacts with the intellectual property management section of the city department。
(v) workstations conduct performance appraisals each year for excellent and qualified qualifications. Qualifications are denied if they do not take part in the annual examination; if they are disqualified for two consecutive years; and if they violate the relevant provisions of the laws and regulations。
Article 10, the market supervision authority of the city of gyan, grants some financial support to workstations and an award of $50,000 to workstations that perform well on the annual performance appraisal。
The market supervisory authority of each county (city, district) under article 11 shall provide some financial support for the work of the workstations within its jurisdiction, within the limits of law and policy, by reference to the municipal councils。
Article 12 of this scheme is interpreted by the market supervision authority of the city of gian。
Article 13, this approach will apply from the date of its issuance。
