With a view to raising awareness in society as a whole of respect for and protection of intellectual property rights and actively promoting the building of a strong intellectual property state, on the occasion of world intellectual property day 22, the national intellectual property awareness week working group decided to organize a national intellectual property awareness week 2022, to strengthen intellectual property protection and education and to fully shape the intellectual property culture of respect for knowledge, innovation, good faith and competition。
World intellectual property day
World intellectual property day was established by the world intellectual property organization on 26 april 2001 and it was decided to designate 26 april of each year as world intellectual property day, starting in 2001, with the aim of creating a worldwide awareness of respect for knowledge, science and the protection of intellectual property rights, as well as a legal environment that encourages intellectual innovation。
What is intellectual property
Intellectual property rights are the legal exclusive rights of citizens, legal persons or other organizations in respect of the intellectual works they have created。
Intellectual property is an intangible property right, including personal and property rights, also known as moral and economic rights. Like tangible property such as houses, cars, etc., it is protected by national law and has value and utility。
Intellectual property rights include, inter alia:
1. Copyright and neighbouring rights。
Patent rights, i. E. Exclusive rights of natural persons, legal persons or other organizations to inventions, practical novelty and visual design for a certain period of time in accordance with the law。
3. Trademark rights, i. E., the rights of the registered trademark holder or successor to the right to a registered trademark within the legal period。
4. The right to commercial secrecy, i. E. The exclusive right of a civil subject to the law to technical or operational information that is a commercial secret。
5. The right to new varieties of plants。
6. Design rights for integrated circuit maps。
Commercial rights, i. E. The exclusive use of commercial subjects in accordance with the law within a geographical area。
Intellectual property rights in everyday life
Copyright includes the right to literary, artistic and scientific works (author's rights); the right to perform, audio and video works (neighborship rights); and the right to write computer software。
In everyday life, novels, films, including our dissertation, are all about copyright in intellectual property。
How ordinary people benefit from intellectual property rights
1. To encourage and promote innovation, accelerate social development and protect and promote the creation of more scientific, technological, cultural and artistic intellectual achievements in productive practices and scientific experiments, thereby accelerating the process of development of human society and ultimately benefiting it。
2. Improving the quality of goods and services and improving people's lives, such as the protection of trademark rights, will encourage operators to improve the quality of goods they produce or the quality of services they provide, and their ultimate beneficiaries will be consumers in general。
To provide direct access to benefits, ordinary people may also acquire intellectual property rights through creative activities, thereby obtaining direct benefits from the conversion or implementation of intellectual property rights。
How to apply for intellectual property
Take the example of copyright applications for computer software:
The application documents that must be submitted for the registration of copyright for computer software are:
1. Application form for the registration of copyrights in computer software。
2. Identification of the applicant. Enterprise: copy of licence (to be stamped); enterprise: copy of certificate of corporate code (to be stamped); individual: copy of identity card。

Which abuses of intellectual property rights
The unauthorized use of the same or similar trademarks, distinctive signs, patents, works and other creations in production, operation, advertising, performances and other activities

What about the infringement of intellectual property rights
In case of infringement of intellectual property rights, relevant materials should be prepared when reporting。
1. The complainant is the owner of the intellectual property and is requested to provide a patent, trademark registration certificate, copyright certificate, etc.
2. The complainant's non-intellectual owner should be provided with a patent certificate, a trademark registration certificate, a copyright certificate and supporting documents (with the signature/search of the intellectual property) authorizing the complainant to file a complaint。
