In order to ensure the effective protection of cultivated land and to ensure food security in the country, in accordance with the provisions of relevant laws and regulations, such as the law of the people's republic of china on land management, the law of the people's republic of china on contracting rural land, the regulations on the protection of basic agricultural land, and the regulations on the implementation of the law of the people's republic of china on land management, the following information is provided on matters related to the prohibition of the cultivation of grass on arable land and permanent basic agricultural land:
1. The cultivation of grass on arable and permanent basic agricultural land is prohibited. The planting of grass and the shoveling of grass on arable and permanent basic agricultural land have caused serious damage to the croplands, in violation of the provisions of article 37 of the law of the people's republic of china on land management, article 17 of the regulations on the protection of basic agricultural land and article 12 of the regulations on the implementation of the land administration law of the people's republic of china. As soon as it is established, in accordance with article 75 of the law of the people's republic of china on land administration, article 33 of the regulations on the protection of basic agricultural land, and article 55 of the regulations on the implementation of the law of the people's republic of china on land management, the authorities concerned shall, in accordance with the law, impose a fine of five to ten times the cost of clearing arable land, which constitutes an offence and shall be held criminally liable in accordance with the law。
2. Towns ( streets) and villages (communities) should conduct timely screenings and improve rehabilitation. In accordance with articles 42 and 64 of the law of the people's republic of china on contracting of rural land, the contracting party shall unilaterally cancel the contract for the transfer of ownership of the land for the purpose of changing the agricultural use of the land and causing serious damage to the land by the owner of the land and shall not releasing, renewing, subletting the cropland and the permanent basic agricultural land for the cultivation of grass。
Thirdly, units that occupy arable land and permanent basic agricultural land in our city (the duty bearers) must immediately cease the cultivation of grassland, limited to its full installation by 8 february 2023 and its resumption. In the event of a delay, the competent authorities of our municipality will carry out investigations in accordance with the relevant laws and regulations。
This circular shall be implemented from the date of its issuance。
