What are the main forms of protection of intellectual property rights?
One is legal and the other is technical。
Technical protection is more accessible to us, such as technical measures such as encryption dogs, encryption cards or diskettes, restrictions on the copying or use of software, which are mostly used in our country, but at the same time place an additional burden on development efforts and inconvenience for users. Most countries, on the legal front, provide intellectual protection through copyright law。
However, with advances in technology, such technological protection measures are not indestructible. Technical protection is not sufficient to protect intellectual property rights on the internet at all, and it is even more in need of legal protection。
Intellectual property rights can be divided into two broad categories: copyrights, including neighbouring rights, and industrial property rights, mainly including patent and trademark rights. There is a common understanding of the scope of industrial property rights around the world that “industrial property rights should be understood in the broadest sense and should apply not only to business itself but also to agriculture and extractive industries and to all manufactured or natural products”。
Our intellectual property rights include copyrights, patents, trademarks, discovery rights, inventions and other scientific and technological achievements. Among these, the first three types of rights constitute the subject of intellectual property in our country, and they are the main ones in construction activities。
Scope of protection of intellectual property rights
The scope of intellectual property protection is as follows:
1. Copyright and neighbouring rights。
2. Trademark rights。
3. The right to geographical indications。
4. Right to industrial design。
5. Patent rights。
6. The right to design integrated circuit maps。
7. The exclusive right to disclose information。
There are two narrow categories of intellectual property rights: copyrights (also known as copyrights, literary property rights), including copyrights for computer software and copyrights for works. The other category is industrial property (also known as industrial property), which includes mainly patent and trademark rights。
Broadly defined intellectual property rights include copyrights and their adjacent rights, patents, trademarks, trade secrets, business name rights, integrated circuit charting rights, new varieties of plants, geographical indications, industry quality tagging rights, etc。
Under article 3 of the trademarks act, trademarks registered with the approval of the trademark office are registered trademarks, including trademarks for goods, service trademarks and collective trademarks, proof of trademarks; the trademark registrant has the exclusive right to trademarks and is protected by law。
The protection of intellectual property rights can be protected by technology and law in two ways: the content of intellectual property rights, including copyright, patent rights, trademark exclusive rights, discovery rights, inventions and other rights of scientific and technological achievement, including copyright and neighbouring rights, the right to design integrated circuit maps, the exclusive right to information for disclosure, the right to geographical indications, etc。
