The programme for the construction of intellectual property power (2021-2035) (hereinafter referred to as " the programme " ) requires that, by 2035, china's characteristics and world-class intellectual property power will have been largely established. In this process, it is particularly important to build a human and social environment compatible with china's characteristics, world level and high quality development of intellectual property rights. To that end, the platform identified “building a human and social environment for high-quality development of intellectual property rights” as one of the six main priorities of building a strong intellectual property power。
A number of development indicators show the evolution of the human and cultural environment of intellectual property rights in the country in recent years. China's ranking in the world intellectual property organization's global innovation index report rose from 22nd place in 2017 to 12th place in 2021, with a steady middle-income economy, one of the fastest-growing countries in the world. Since april 2013, we have published an annual survey of social satisfaction with intellectual property protection. It shows that the social satisfaction of intellectual property protection in our country rose from 76. 69 points in 2017 to 80. 61 points in 2021, and that there has been significant progress in the human environment. The development goal set out in the platform “by 2025, the protection of intellectual property rights will be more stringent and the level of social satisfaction will be higher; by 2035, the culture of intellectual property rights in society will have developed itself”。
The four working principles of the platform reflect the building of a human and social environment conducive to high-quality development of intellectual property rights. Among other things, it seeks to ensure that social justice and the legitimate rights and interests of rights-holders are upheld; to deepen reforms in the area of intellectual property rights and to develop better mechanisms for the marketing of the elements; to maintain strategic direction and integrated planning for the further integration of intellectual property rights into economic, scientific, cultural and social development; and to uphold the common vision of human destiny and to promote the construction of international rules on intellectual property that are inclusive and balanced, so that innovation is created to benefit all people more。
The platform calls for a culture of intellectual property that respects knowledge, embraces innovation, upholds good faith and fair competition. This enriches and refines the content of the intellectual property culture in comparison to the national intellectual property strategy framework issued in 2008 and upgrades the development of the intellectual property workforce and the intellectual property culture to the human and environmental dimension of intellectual property。
The platform emphasizes the three-pronged approach of education, practice and institution in the development of a voluntary practice of respecting and protecting intellectual property rights. In response to the platform's call for “a level playing field and a new era of intellectual property culture of self-awareness and cultural self-confidence”, the author believes that this is a long-term and difficult task that requires a combination of quality education, talent development, training of cadres, regulatory constraints, institutional and legal guarantees, so that the intellectual property culture can be embedded in the public domain。
The platform introduces a new concept: a matrix of cultural dissemination of intellectual property that is innovative, diverse and inclusive of development. “culturing an intellectual property cultural communication platform for the integration of traditional and emerging media, expanding new media channels such as social media, short video, and client media” is the focus. Media-wide communication patterns should be used to move the culture of intellectual property forward; reinforce the interactive experiences of rights-holders, consumers, service providers, regulators, law enforcement, and promote the technological wings of the intellectual property human environment; and proactively provide “four-media” communication services for the creation, use, protection, management, services, etc. Of intellectual property rights, and effectively enhance the dissemination and impact of intellectual property culture。
From intellectual property owners, such as inventors, service providers and law enforcers, to innovative businesses, such as huacheng and daejiang, there are many examples of intellectual property rights supporting high-quality economic development. We urgently need to explore content, develop channels, cover the entire media and create new brands. The cultural dissemination matrix of intellectual property rights should be used to tell the story of china's intellectual property rights and to project the image of the great civilized and responsible power。
In creating a more open, dynamic and dynamic environment for intellectual property talent development, talent development, evaluation, motivation, mobility and deployment systems and mechanisms are command sticks that encourage attracting high-quality human resources into the intellectual property field. The platform calls for improved mechanisms for intellectual property talent development, evaluation incentives and mobility. Encouraging the establishment of ipr-level disciplines was a major breakthrough in the development of ipr disciplines. The creation of a subject at the level of intellectual property rights will facilitate the integration of high-quality teaching and scientific resources in institutions of higher learning, the award of a doctorate and master's degree in intellectual property and the development of a large pool of highly qualified intellectual property rights。
At the same time, intellectual property rights work involves a wide range of legal and regulatory aspects, science and technology, economics and trade, and culture, and requires a more professional workforce. The platform explicitly strengthens the capacity of public lawyers in intellectual property administration. This will further improve the effectiveness of the enforcement of intellectual property rights and the level of services in our country, and will meet the multi-layered demand for legal services from a variety of legal persons and the public in society. On the other hand, as our country's involvement in global intellectual property governance and international cooperation deepens, the pace at which business “gos out” “in and out” is accelerating, it is important to put into practice the call in the platform for “development and training of foreign intellectual property lawyers to strengthen the internationalization of intellectual property”。
