What is intellectual property
Intellectual property means the legal right of a natural or legal person or other organization to occupy, use, dispose of and profit from its intellectual property. Intellectual property rights are the exclusive rights of the right-holders under the law with respect to: (i) works; (ii) inventions, practical novelty, appearance design; (iii) trademarks; (iv) geographical indications; (v) trade secrets; (vi) design of integrated circuits; (vii) new varieties of plants; and (viii) other objects provided for by law。
What are the elements of iprs
Intellectual property rights mainly include copyrights, trademarks and patents。
Copyright: refers to a series of exclusive rights of authors of literary, artistic and scientific works to their works. The works include works of writing, oral works, music, theatre, music, dance, acrobatic arts, fine arts, architecture, photography, audiovisual works, graphics and model works such as product designs, maps, diagrams, computer software, etc。
Trademark rights: this refers to the exclusive and exclusive rights of the trademark holder with respect to his trademark, which are commercial symbols used to distinguish between different sources of goods and services, including the composition of words, graphics, letters, numbers, three-dimensional symbols, colour combinations, sound or combinations of the above elements。
Patent rights: are the exclusive rights of inventors or transferees of their rights to the legal enforcement of particular inventions for a certain period of time, divided into inventions, practical novelty and visual design。
How to obtain trademark rights, copyrights, patents
Copyright registration. Once a work has been completed, it is automatically copyrighted and protected by law, whether published or not. The registration of copyrights is voluntary in nature and its purpose is to establish the attribution of rights to works and to obtain evidence in the event of future disputes, which is the responsibility of the copyright authorities and their designated bodies。
Patent application. The applicant shall submit a patent application to the state intellectual property office in accordance with the law and may also entrust it to the patent agent。
Trademark registration. An application for registration of a trademark shall be submitted by the applicant to the state intellectual property office in accordance with the law and may be entrusted to a trademark agent。
Duration of intellectual property protection
1. Copyright: the right to sign, to modify and to protect the integrity of a work is protected for an indefinite period of time, the right to publish and other property rights for citizens for life and 50 years after death, the legal person for 50 years after publication and the right to write computer software for 50 years。
Patent rights: 20 years of patent for inventions, 10 years of patent for practical novelty, 15 years of patent for visual design, calculated from the date of application。
3. Trademark rights: are valid for 10 years from the date of approval for registration and may be renewed。
