I. How micro-enterprises can apply for the return of trade union funds (constitution preparation fund)
The circular issued by the general trade union of hainan province (jong dynasty 11) provides that eligible micro-enterprises may apply for the return of trade union funds (constitution preparation fund) declared between 1 january 2021 and 31 december 2021, whichever is the date of declaration。
(i) conditions for return
An enterprise applying for the return of trade union funds (preparation money) shall meet the following conditions:
1. In accordance with the circular on issuance of standards for sme modelling (unisu) [2011] 300) or circular on the implementation of inclusive tax relief for small microenterprises (2019) the list of micro-enterprises in the regulations or in the national system for the disclosure of business credit information, which meets the criteria for the modelling of micro-enterprises
2. Establishment of trade union organizations and micro-enterprises with independent bank accounts of trade unions in accordance with the law。
(ii) duration of return: from 1 january 2021 to 31 december 2021, whichever is the date of declaration。
(iii) time limit for applications: from the date of issuance of documents to 30 september 2022

3. Certification of union contributions (preparation payments)
4. Licence to open trade union accounts
5. Return of the application form for the financing (preparation) of the trade union for micro-enterprises in hainan province

(v) return process
Qualified micro-enterprises submit their application to the competent trade union of the province of hainan for the return of the funds (preparation money) in accordance with the principles of management and “collection and return” of the micro-enterprises. Following the examination of the information by the competent trade union department responsible for the organization of trade unions, the financial department of the competent trade union returns the funds requested to the account of the enterprise union。
Micro-enterprises that cover union unions are requested by union unions and the funds are returned to union accounts。
2. Micro-enterprises contributing across regions are collected and returned in accordance with the principles of management and financial attribution。
3. Micro-enterprises that do not form trade unions may apply to their superior trade unions for the return of trade union funds (preparation money) upon application for the establishment of a trade union。
According to the circular of the general trade union of hainan province on the continuation of the support policy for the financing (preparation money) of the small microenterprises union (jongdu no. 1) the full return of the small microenterprises union's funding was extended until 31 december 2022, whichever is the date of declaration. An application for return may be filed by 30 september 2023。
Where can union funds be spent
According to the administration of income and expenditure of grassroots trade unions in hainan province (jong dynasty 2), trade union funds can be used to:
(i) days of condolence are granted to all members by the grass-roots trade unions on the occasion of the annual festivals (new year, spring, ching ming, labour day, midday, mid-autumn, national autumn and national minority days approved by the people's governments above provincial level). The annual sum of each member is not more than $1,500 and not more than $500 a single time, and cannot be paid from the administrative subsidy income. In principle, the holiday condolences are goods that are in line with traditional chinese festival habits and essential items for the livelihood of the workers. In conjunction with practical and flexible distribution, grass-roots trade unions may issue vouchers in kind or goods, but may not issue cash or shopping cards。
(ii) on their own birthday, members may receive condolences such as birthday cakes from the grass-roots trade unions, or tickets for cakes from designated cake shops, for which the standard must not exceed $200。
(iii) when a trade union member marries or gives birth to a child, the grass-roots union may give a condolence (condolence) of up to $500 each。
(iv) if a trade union member is sick and hospitalized, the grass-roots union may pay a condolence grant of up to $1,000. In the event of the death of a trade union member, a condolence grant of up to $5,000 may be granted, and in the event of the death of a member's immediate family, a condolence allowance of up to $2,000 may be granted. Grass-roots trade unions need to develop their own methods of implementation and refine the number and standard of condolences。
(v) a member of a trade union who retires from his or her post and may issue souvenirs worth up to $500。
Iii. Prohibitions on the use of trade universal funds
(i) the use of union funds is not permitted for gifts。
(ii) it shall not be permitted to award bonuses, allowances or subsidies indiscriminately, in violation of the rules governing the use of trade union funds。
(iii) trade union funds are not allowed to be used for high-consumption recreational and fitness activities。
(iv) to deny the administration access to trade union accounts and to establish a small treasury。
(v) the exclusion of union accounts from consolidation into unit administrative accounts and the loss of control over trade union expenditure。
(vi) the interception or diversion of trade union funds is not permitted。
(vii) not to engage in illegal fund-raising activities with union funds or to provide financial guarantees for illegal fund-raising activities。
(viii) trade union funds are not allowed to cover expenses unrelated to union activities。

In the event of a failure to distribute the winning information as a result of an error in filling out the winning information, the result is the member's own responsibility
7. Changes to the receiving address, if required, should be made on the day of the award by 17:00 on the winning record interface and no longer be accepted by the platform after the expiry of time
The distribution area is restricted to hainan province and is not distributed outside the province. In the event that a member is unable to make a distribution due to an error in filling in the receipt information, the member is responsible for the consequences。
