In order to follow up on the party's central and state council decision-making and to improve the system for the evaluation of intellectual property rights, the national intellectual property administration, in collaboration with the people's bank of china and the general administration of state financial supervision, has prepared the recommended national standard patent evaluation guidelines (national standard gb/t42748-2023, hereinafter referred to as " guidelines " ), which have recently been approved and issued by the general directorate of state market supervision (national standardization management committee) and will be implemented as of 1 september 2023。
The guidelines provide a basic methodological tool for patent evaluation, which can lead to a better understanding of the institutional characteristics and application patterns of patents, a more comprehensive assessment indicator and a more scientific assessment methodology. On the basis of piloting and extensive consultation in the early stages, the guidelines have developed a system of scalable, operational indicators for assessing patent value, including 3 indicators at the level of legal value, technical value, economic value, 14 indicators at the level of secondary, 27 indicators at the level of tertiary level and a number of expansion indicators. Scientific guidance on the selection and weighting of indicators in different contexts, such as licence transfers, finance, fiscal, tort relief, hierarchical management, etc., is available for use by subjects such as enterprises, universities, scientific organizations, financial institutions, evaluation institutions, etc., on the basis of actual needs and specific scenarios, on the basis of which negotiations or integrated market information analysis have been undertaken to facilitate the achievement of patent market pricing and value。
As a next step, the national intellectual property authority will work with the relevant authorities to increase the dissemination of the guidelines, promote the improvement of patent evaluation mechanisms, enhance patent evaluation capabilities, provide the basis for patent conversion applications, and promote the orderly flow and efficient allocation of innovative resources。
