The regulations for the promotion of clean and efficient use of coal in shanxi province were adopted by the standing committee of the thirteenth people's congress of shanxi province at its thirty-eighth meeting, on 9 december 2022, and are now published and implemented as of 1 january 2023。

Chapter i general provisions
In order to promote the clean and efficient use of coal, guarantee the achievement of carbon peaks, carbon neutrality and targets, and promote quality development in all its aspects, this regulation is drawn up in accordance with the relevant laws, administrative regulations and practices of the province。
This regulation applies to the promotion of the clean and efficient use of coal and its supervision and management activities within the province's administrative area。
Clean and efficient use of coal, as defined in this regulation, refers to activities that reduce energy consumption, control and reduce pollutants and greenhouse gas emissions and increase the efficiency of coal use during coal production, processing, transport, use and conversion。
Article 3 the promotion of the clean and efficient use of coal should be guided by the principles of government guidance, market-driven, science and technology support and social participation。
Article 4 people's governments above county level shall strengthen leadership in the promotion of the clean and efficient use of coal, integrate the clean and efficient use of coal into national economic and social development planning, establish deliberative coordination mechanisms, and study the major issues in the promotion of the clean and efficient use of coal, with financial resources to be secured。
The commune/town people's government and street offices assist the authorities in the clean and efficient use of coal for promotion。
Article 5 energy authorities of people's governments above county level are responsible for organizing, coordinating and directing the promotion of the clean and efficient use of coal。
In accordance with their respective responsibilities, the relevant departments of the people's governments above the county level, such as development reform, science and technology, industry and information, finance, ecological environment, housing and urban-rural construction, transport, market regulation, statistics, etc., are responsible for the promotion of the clean and efficient use of coal。
Article 6 the media, such as radio, television, the press and the internet, should strengthen the clean and efficient use of coal to promote knowledge。
Article 7. Units and individuals above county level who have made a significant contribution to the clean and efficient use of coal are recognized and rewarded in accordance with national and provincial regulations。
Chapter ii planning and management
Article 8. The provincial people's governments and the municipal governments of the established districts shall prepare plans for the clean and efficient use of coal, with clear objectives, priorities and safeguards to be linked to territorial spatial planning and ecological environmental protection planning。
The county (city, district) people's government should prepare and organize the implementation of the clean and efficient use of coal plan, based on the clean and efficient use of coal plan, in conjunction with the local reality。
Article 9 the provincial people's governments shall optimize the industrial layout, promote the integrated development of coal and electricity, coal and coal-chemical industries and support joint ventures。
Article x. People's governments above county level shall exercise reasonable control over the total amount of coal consumed, improve the structure of energy consumption, promote the optimal mix of energy, promote alternatives to coal fuel and gradually reduce the share of coal in energy consumption。
Article 11: powered coal, smoke-free coal and coal-charting shall be used efficiently and rationally according to the diversity of coal species, demand and access。
Special and scarce coal species, such as fat coal, coke coal, thin coal and smoke-free coal, should be used as a priority in the metallurgy, chemical, material and other industries, limiting the direct use of special and scarce coal as fuel。
Support to enterprises and research institutes in the development of low-grade coal transfer technologies, encourage enterprises to apply low-grade coal conversion technologies, and to develop low-grade coal classification ladders to promote the clean use of resources and energy ladders。
Chapter iii production and processing
Article 12 encourages and supports coal-producing enterprises to promote green, intelligent production methods, based on the actual use of mining techniques and equipment such as filling mining, water conservation, coal mining and co-production resources。
Article 13 the provincial people's governments should optimize the layout of coal-washing enterprises, establish a filing system for coal-washing enterprises, regulate the development of coal-washing enterprises and phase out backward production capacity。
The energy authorities of people's governments above the county level should strengthen the standardized management of coal washing enterprises。
The construction of new coal mines should be accompanied by the simultaneous construction of coal washing facilities, the introduction of advanced coal washing techniques and equipment, and the improvement of the level and quality of primary coal。
Article 14. The provincial people's governments shall promote the construction of coal transport corridors and their ancillary facilities, optimize the coal transport structure and increase the proportion of rail transport and transport efficiency。
Support to enterprises such as coal, electricity, focal, steel and large coal logistics parks and coal distribution centres to build railway lines。
Article 15 encourages coal producing and operating enterprises to build coal distribution centres in mining areas, major coal-consuming areas, and to refine coal for distribution。
Chapter iv utilization and transformation
Art. 16 coal-fired power generation enterprises should perform coal-saving and flexible re-engineering of existing coal-fired generators, and heat retrofitting of pure condensers with heating conditions。
Article 17 new construction, retrofitting and expansion of focal projects should be based on the autoheating control of the oven, with a dry-out mechanism。
Cocalators should enhance the integrated use of by-products such as stove gas, kerosene, coarse benzene, extend industrial chains and increase product value addition。
Article 18 encourages and supports enterprises to improve the efficiency of the integrated use of coal as a chemical material and to optimize the structure of coal-chemical products。
Support for coal industry enterprises in the production of high-end carbon materials, coal oil, carbon-based synthesis of new materials and end products。
Article 19 coal-fired power companies should combine the use of excess heat resources, such as boilers and chillers。
Focal firms should combine the use of excess heat resources such as dry stoves and flue gas。
Iron and steel smelters should combine the use of excess heat resources in the production process, such as sintering, ball groups, furnaces, transcribers, etc。
Coal-fired enterprises are encouraged to use other heat resources in combination, such as coal-fired power generation, focal and steel smelting。
Article 20. The provincial people's governments shall establish technical standards for sub-filling of coal plumb wells, ground backfilling, etc., and regulate the integrated use of coal plumbstone。
The people's governments above the county level should support the use of coal quarries and dust for the production and construction of green building materials。
Article 21: the gowas, coal and gas monuments shall be accompanied by the construction of gas utilization facilities。
Article 22 encourages enterprises, scientific institutions and institutions of higher learning to undertake technological research and promotion in areas such as coal mining with co-generation resources, efficient combustion of coal for power generation, and cleaner and efficient conversion of coal。
Article 23 encourages the development of technologies, process demonstrations and industrialization applications for coal-fired power generation, cocaling, metal and steel smelting, etc。
Article 24 - support enterprises, scientific institutions and institutions of higher learning in research and development of technologies and equipment for coal power and new energy sources。
Chapter v
Article 25 the provincial people's governments should increase their financial resources to support research and development, upgrading, demonstration of applications and industrial development for the clean and efficient use of coal technologies, processes, equipment and products。
The people's governments of the established municipalities and counties (municipalities and districts) shall implement, in accordance with the law, policies of support such as taxation, land, etc., and establish specific funds to promote the efficient and effective use of coal through financial subsidies, the purchase of services, loan discounts and guarantees。
Encourage and support the participation of social capital in research and development for the clean and efficient use of coal and in the investment, construction and operation of projects。
Article 26 the energy authorities of the provincial people's governments should establish public service platforms for the clean and efficient use of coal and provide information and counselling services to society, such as laws and regulations, policy documents, standard norms, financial services, security of interests, etc。
Article 27 enterprises in countries where coal is produced, processed and used should increase the clean and efficient use of research and development inputs. Relevant authorities should include the clean and efficient use of r & d inputs by state-owned enterprises in the performance evaluation of enterprises。
Article 28. The personnel of the people's governments at all levels and of the relevant departments, such as the energy authorities, who are guilty of negligence, fraud or abuse of authority, shall be punished in accordance with the law and shall be held criminally liable in accordance with the law。
Chapter vi
Article 29 these regulations shall become effective on 1 january 2023。
