3. Domain name determination
In terms of the definition and content of domain names, enterprise domain names are characteristic of intangible assets。
(i) enterprise domain name rights are only the right of an enterprise to obtain the only internet address. It has no physical entity. It's invisible, untouchable, untouchable. It's an intangible asset。
(2) greater uncertainty. As a result of the rapid development of contemporary science and the accelerated upgrading of technological knowledge, the economic benefits of enterprise domain names to enterprises and their own economic lives are difficult to determine, leading to prices or costs. In addition, the value of domain names transferred as a result of loss is difficult to determine because of the uncertainty of the cost of acquiring domain names。
(iii) domain name rights cannot be separated from the tangible assets of a particular enterprise or enterprise. Once the enterprise domain name (web site) leaves the specific enterprise, it becomes a worthless code name. Finally, the enterprise's domain name is exclusive and unique. Owing to the unique and mapable nature of the domain names registered online, domain names are “exclusive”。
(b) if an enterprise applies for registration on its own motion, it shall register with the enterprise. It will be confirmed on the day of recognition and protection。
Ii. Characteristics of domain name rights
1. Domain name is intangible asset
The domain name, which is the only identifier for an enterprise on the internet, has a prominent recognition function. To some extent, it represents the image of an enterprise, its credibility, the quality of goods and services, and the business reputation of domain name holders. Closely linked to other reputations, honours, the commercial value lies not only in the domain name itself, but, more importantly, in the rich cultural heritage of the holders, which has enormous intangible value。
2. Domain names are proprietary
As a symbol of the holders of domain names on the internet, domain names are the only ones globally and it is impossible to have two identical domain names. It is this technical feature of the domain name registration system that determines the indisputable exclusivity of domain names. Only the right person (domain name holder) can use the domain name on the network. Otherwise, no one can use it. Neither do i。
3. Time-sensitive domain names
Domain names are subject to regular review or will be removed. Article 19 of the rules for the implementation of the registration of internet domain names in china provides that an annual inspection (similar to the renewal of trademarks) must be carried out every year after a domain name is registered. A valid domain name shall be deemed to have been completed and paid within 30 days from the date of the annual inspection. The domain name will be suspended if the annual inspection and fees are not completed within 30 days. If the annual inspection and the payment of fees are not completed within 60 days, the domain name will be withdrawn. Thus, domain names are not time-limited rights。
4. Regional domain names
The geographicality of domain names is expressed in the network as being “geographical”, unlike other traditional types of intellectual property in the real world。
Domain names have characteristics such as exclusivity and there are no two identical domain names. A domain name is required to be regularly checked after it is registered, otherwise it will be withdrawn. The valid domain name is only deemed to be completed and paid within 30 days from the date of the annual inspection。
