1. What is drugs
The criminal law of the people's republic of china, article 317, defines drugs as opium, heroin, methamphetamine (ice), morphine, cannabis, cocaine and other narcotic drugs and psychotropic substances that are subject to state control and can cause addiction。
What are the characteristics of drugs?
Drugs have four basic characteristics: dependence, tolerance, illegality and harm。
1 dependency: in a cyclical or chronic state of poisoning, the continued use of the drug is required to sustain the essential physiological activity of the organism, otherwise a series of dysfunctions and damaging reactions (known as abstinence symptoms or detoxification)。
Resistance: because of drug resistance, most drug users experience a gradual increase in each drug use, a reduction in the interval between drug use and the conversion to intravenous injection。
Illegal: under our law, drug abuse is an offence punishable by law, and the smuggling, trafficking, transport and manufacture of drugs, the illicit cultivation of narcotic plants, the illegal possession of drugs and the coercion of others to use drugs are offences。
Harm: the proliferation of drugs is a great danger not only to drug users themselves but also to their families and societies. It is tantamount to destroying themselves, harming families and endangering societies。
What are the dangers of drugs
1 the physical health of the victim: drugs poison vital tissues, organs, disrupting and disrupting normal metabolisms of the human body and are highly susceptible to all kinds of conditions. Intravenous drug use is often associated with a combination of infections, with the common occurrence of infectious diseases such as hepatitis b, aids and syphilis, which seriously result in the death of drug users。
The mental health of a person is impaired by the fact that many drugs directly alter the structure of some chemical substances in the human brain, disrupt or disrupt the normal activity of the human nervous system, or even poison or damage the nervous system, leading to mental, psychological, intellectual, sexual depravity, indifference and isolation, physical distortion and even psychosis。
Disruption of family harmony: when drug addiction occurs, drug addiction increases and the dose increases, to a certain extent the sale of household property for drugs is inevitable, leaving the family in limbo. Drug users are desperate for their spouses and families, and the vast majority of the families in which they live are fragmented, while children growing up in such families are more vulnerable to criminal behaviour due to lack of family care。
It endangers the progress and development of society: drug abuse and crime are twin brothers. Without a source of drug financing, drug users are gradually engaging in criminal offences such as prostitution, theft, abduction, robbery, smuggling, drug trafficking and homicide. The increase in drug abuse has led to various criminal activities, disrupted public order and posed a great threat to the population。
4. Are drugs far from adolescents
“narcotic crime” seems to be out of reach, but it is not far from us, even near the children。
Adolescents are not protected from drugs because of their young age. Young people are less able to identify and control themselves, either by being lured into drug contamination by undesirable persons, or by parents who are divorced or absent for a long time, lack family education, drug abuse and drug addiction out of curiosity。
It is worth noting that many drug offences involving young people are related to places such as ktv, bars, cybercafes, dance halls, etc., which are explicitly prohibited under the relevant laws and regulations of the country。
Article 347 of the criminal law of the people's republic of china. Smuggling, trafficking, transport and manufacture of drugs, regardless of their quantity, are subject to criminal liability and penalties。
The smuggling, trafficking, transport and manufacture of drugs shall be punishable by fifteen years ' imprisonment, life imprisonment or death, and confiscation of property if:
(i) smuggling, trafficking, transportation, manufacture of more than one kilogram of opium, heroin or methamphetamine over 50 grams or other drugs;
(ii) leading elements of smuggling, trafficking, transport and manufacturing drug groups;
(iii) armed cover for the smuggling, trafficking, transport and manufacture of drugs;
(iv) violent resistance to inspection, detention, arrest, aggravated circumstances;
(v) participation in organized international drug trafficking。
Smuggling, trafficking, transportation, manufacture of more than 200 grams of opium less than 1 kg, heroin or more than 10 grams of methamphetamine less than 50 grams or other drugs are punishable by a term of imprisonment of more than seven years and a fine。
The smuggling, trafficking, transport, manufacture of opium under 200 grams, heroin or methamphetamine under 10 grams or other small quantities of drugs is punishable by imprisonment for a term not exceeding three years, detention or control, and a fine of not more than seven years in serious cases。
If a unit commits an offence under paragraphs 2, 3 or 4, the unit shall be liable to a fine and the person in charge and other persons directly responsible shall be liable in accordance with the provisions of those paragraphs。
Anyone who uses or incites minors to smuggle, sell, transport, manufacture or sell drugs to minors shall be subject to heavier penalties。
In the case of multiple smuggling, trafficking, transport and manufacture of drugs, the amount of drugs is calculated cumulatively without treatment。
Article 72 of the law on administrative penalties for public security provides that any person who:
(i) illicit possession of less than 200 grams of opium, heroin or methamphetamine less than 10 grams or other small quantities of drugs;
(ii) the supply of drugs to others;
(iii) drug users who inject drugs;
(iv) coercion and deception of medical personnel to produce narcotic drugs and psychotropic substances。
According to the law of the people's republic of china on drug control and the regulations on drug rehabilitation, if a drug addict is found to be addicted to drugs, he shall also be subject to the prescribed measures for drug rehabilitation。
