“in order to take full advantage of the important role played by the intellectual property system in stimulating innovation, promoting cultural heritage and regulating the market order, and creating a sound intellectual property protection environment, we have jointly developed a number of measures to strengthen the intellectual property protection of the literary industry, in conjunction with the provincial public security offices, the provincial cultural and tourism offices, the provincial market regulatory authorities, the departmental copyright authorities and the provincial prosecutor's office。
The measures are divided into five main sections. Focusing on strengthening the protection of the cultural heritage industry's sources, it is proposed to encourage leading cultural services, businesses, practitioners and artists in general to patent, register trademarks, intellectual property rights in data and copyrights for artistic creations, tourism performances, design of creative products, digital cultural products, etc., with geographical characteristics; to support projects to channel intangible cultural heritage representatives and heirs to protect the active use of copyrights, trademarks, patent rights, geographical indications, etc., of qualified craftsmanship, performing arts, etc.; to explore commercial secrecy protection of traditional crafts, old characters, etc.; and to encourage innovative transformation of non-residual elements and the formation of new intellectual property rights. The measures provide a full chain of protection for tourism goods, audio-visual works, fairs, performances, mascots, concessions, etc., by strengthening the identification of geographical indications in the western mandarin area and the establishment of a mechanism for the verification of intellectual property links in the area of sound arts performance。
In addition, the measure strengthens regulatory enforcement in priority areas and proposes the organization of specific enforcement actions for intellectual property protection around priority brigade regions and key time points to cleanse the market environment in response to abuses of intellectual property rights, such as the production and sale of abusive creative products。
In order to optimize the investment climate, the measure promotes efficient resolution of intellectual property disputes in the civil service through multiple avenues such as judicial protection, administrative protection, conciliation and arbitration, by encouraging industry associations, chambers of commerce, third-party institutions to participate in intellectual property dispute mediation, and by supporting arbitration institutions to conduct civil service intellectual property dispute arbitration。
In order to promote the integration of cultural innovation, the measures encourage technological innovation in areas such as intellectual tourism, immersional experience, the digital protection and use of cultural heritage, the manufacturing of cultural tourism equipment and the monitoring of cultural heritage, linking intellectual property rights protection to promote the deeper integration of cultural, tourism, science and technology, finance and data elements, and foster new growth points in the intellectual property derivatives industries of the literary brigade。
