The national patent survey (nps) is an important foundational effort to support the building of a strong intellectual property power. It has been in operation for 16 years since 2008 and nine years since 2016. Deployment to follow up on the mandate of the fourteenth five-year national plan for the protection and application of intellectual property rights on “strengthening the statistical survey of the transformation of intellectual property rights”, under the system of statistical surveys of patent surveys (2024) (no. 116) the following is the notification concerning the organization of a national patent investigation for 2024。
I. Purpose of the investigation
The national patent survey aims to investigate in depth developments in the creation, conversion and protection of patents in our enterprises, to fully understand the fundamental role of the patent system in improving the country's core competitiveness, accelerating the development of new quality productivity and promoting high-quality economic and social development, to analyse problems in the development of our intellectual property rights, and to provide data support for macro-management of intellectual property rights, policy formulation, planning implementation and the building of strong intellectual property rights。
Ii. Context of the research
The 2024 national patent survey focused on the theme “accelerating the development of new quality productivity and solid promotion of high quality development”, focusing on strengthening industry statistical analysis, consolidating patent conversion surveys and deepening patent creation, protection and internationalization surveys。
(i) patent creation. The survey covered patent acquisition methods, research and development cycles and inputs, as well as research and research cooperation in production, and the survey on innovative patent technologies was further strengthened this year。
(ii) patent transfer conversion. The survey covered patent industrialization, patent licensing, transfer, patent enforcement, etc. The unincorporated patent survey was further strengthened this year。
(iii) intellectual property protection. The survey covered the proportion of patent holders exposed to patent infringement, measures to protect rights and effectiveness, and the survey on patent protection related to the digital economy was further strengthened this year。
(iv) overseas intellectual property activities. The survey included overseas patent distribution and product exports, international transfer of patented technology, and protection of intellectual property rights abroad. This year the survey of factors affecting the overseas patent allocation of our enterprises was further strengthened。
(v) green technology patent activities. The survey covered patent innovation, conversion schemes and policy needs for green technology。
Subjects and scope of the investigation
The survey was aimed at patent holders of domestic enterprises with valid patents up to the end of 2023; a sample of 13,000 business patent holders and their 40 million active patents were surveyed; the survey covered 27 provinces, including beijing。
Iv. Inquiring into organizational implementation
The national patent survey was organized by the national intellectual property agency and conducted on the basis of a unified questionnaire, a unified platform and a unified time。
(i) organizational modalities. In the 21 provinces of beijing and hebei, patent investigations are carried out by the regional intellectual property directorate. Pilot projects were conducted in eight provinces, including hebei, liaoning, shanghai, jiangsu, fujian, jiangxi, guangdong and gansu, to expand the number of survey samples taking into account local characteristics and development needs. Patent investigations in the six provinces of shanxi, inner mongolia, guangxi, guizhou, yunnan and xinjiang were commissioned by the national intellectual property agency to be carried out by the beijing zero market survey ltd., a third-party investigator, with the relevant provincial intellectual property offices providing working support. The national intellectual property authority will organize, as appropriate, research and guidance for the members of the investigation team。
(ii) survey sample. The national patent survey uses a combination of sample and focused surveys. The sample of the survey was mainly generated by a tiered random sampling method, while all patent holders of enterprises with patents on more than 50 effective inventions were included in the survey. The necessary survey samples could be supplemented with local work practices. Samples of the survey are available separately. Once the subject of the patent survey has been identified, the enterprises concerned are informed in an appropriate manner (see annex 1 of the 2024 national patent survey notification)。
(iii) questionnaire design. There are two sets of national patent questionnaires: the national patent questionnaire 2024 (effective patent) and the national patent questionnaire 2024 (proprietors)。
(iv) how to fill in. The national patent survey is completed online and the patent investigation platform is available at https://cnipa. Idata3d. Com/gro/2024, with access to computers and mobile phones。
(v) questionnaire issuance recovery verification. The distribution, recovery and verification of questionnaires in 21 provinces of beijing and hebei are the responsibility of the regional intellectual property directorate. Questionnaires, recycling and verification in six provinces, namely shanxi, inner mongolia, guangxi, guizhou, yunnan and xinjiang, were commissioned by the national intellectual property agency to the beijing zero market survey ltd。
(vi) questionnaire review. The national intellectual property authority reviews the questionnaire completion and the non-reviewed questionnaire is returned to the respective organizational unit for verification。
(vii) summary of investigations. Following the completion of the main subject of the national patent survey, 21 provinces in beijing, hebei and beijing zero market survey ltd were requested to send a summary of the patent survey to the strategic planning division of the national intellectual property agency in a timely manner。
(viii) investigation report writing. The centre for intellectual property development studies of the national intellectual property administration (inip) was responsible for supporting the preparation of the national patent survey report, which was completed by mid-november 2024. Eight pilot provinces, including hebei, are requested to submit their patent survey reports to the strategic planning division of the national intellectual property agency in december 2024。
V. Requests for work
(i) high priority and strict quality control. The national patent survey is carried out in accordance with the statistical law of the people's republic of china and the related investigation system. The department of intellectual property rights in the provinces attaches great importance to maintaining the first principle of data quality, strictly enforcing the investigation programme, regulating the investigation process, enhancing the verification of data quality, effectively preventing the falsification and falsification of statistics and ensuring that the data are true, accurate and reliable。
(ii) organizational strengthening and orderly advancement. The provincial intellectual property offices are to be clearly directed by the investigative directorates, with specialized units assigned to carry them forward. Twenty-one provinces, including beijing and hebei, need to enhance the training of personnel, upgrade the professional qualifications of investigation staff, conduct an orderly process of questionnaire distribution, mid-term inspection and recovery, and ensure timely filing of survey subjects. Eight pilot provinces, including hebei, require targeted analytical studies. Six provinces, shanxi and others, have been assigned specialized units to assist beijing zero market survey limited in carrying forward its work, providing support on an as-needed basis, such as information letters, office calls, temporary office space, etc。
(iii) safeguarding focus and strengthening linkages. A total of 154 enterprises in the country have participated in the patent survey for 10 consecutive years, covering 18 provinces, and the dynamic and collaborative nature of the enterprises involved provides an important basis for mapping the status of patent activities in the country, which deserves to be fully acknowledged (see annex 2 for a list of enterprises and provincial information). The provinces will continue to play the leading role of the above-mentioned business model as the focal point for patent statistical surveys, providing investigative safeguards and ensuring continuous reliability of survey data。
(iv) strict adherence to financial systems. Strict financial discipline, earmarking of investigation costs, strengthening of funds management in strict compliance with the relevant financial management systems and regulations, and timely submission of related settlement notes and accounts for project funds。
