The recent publication by the supreme people's court of the people's court of the people's republic of china on the status of judicial protection of intellectual property rights in chinese courts (2023) shows that in 2023 the national court received 544126 new cases of intellectual property rights, concluding 54412, which is essentially the same number as the new collection。
Currently, there are 25 high courts, 242 middle courts and 287 grass-roots courts throughout the country that have organized centralized jurisdiction in civil, administrative and criminal cases of intellectual property. The 12 courts of tianjin, inner mongolia and zhejiang have fully implemented the “triple-to-one” trials of intellectual property cases in three courts within their jurisdiction, effectively enhancing the overall effectiveness of judicial protection of intellectual property。
The vice-president of the supreme people's court, mr. Tau kae, explained that in 2023 the people's court had duly considered intellectual property cases involving high-tech areas such as 5g communications, quantum technology, artificial intelligence, biomedicine, high-end equipment manufacturing, seeding sources, etc., and had strengthened the judicial protection of intellectual property rights in key areas, core technologies and emerging industries. At the same time, strong efforts have been made to combat the malign registration and forgery of trademarks, to strengthen the legal protection of well-known trademarks, traditional brand names and old titles and to strengthen anti-monopoly and anti-unfair competition justice. In addition, the people's court has strengthened its research on the legal protection of artificially intelligent technologies, carried out specialized research on new types of cases, such as the protection of data property rights, explored the improvement of rules for the adjudication of data protection, and provided services to guarantee the innovative development of the digital economy。
On 22 april, the supreme people's court issued 10 major intellectual property cases and 50 typical intellectual property cases in 2023 in chinese courts.
