
I. How long has chinese intellectual property rights been protected

Article 20. The right of authors to sign, to modify and to protect the integrity of their work is not limited。
Article 21. The right to publish, the protection of the rights provided for in article 10, paragraph 1 (e) to (xvii), of this law shall last for the author's life and fifty years after his death, until 31 december of the fifth decade after his death, and, in the case of cooperative works, until 31 december of the fifth decade after his death。
The right to publish, the right to protection of the rights set forth in article 10, paragraph 1 (e) to (vii), of this law shall be for a period of fifty years, as of 31 december, the fifth decade after the first publication of the work, but no more than 50 years after the completion of the work itself。
The right to publish and the protection of the rights provided for in article 10, paragraph 1 (e) to (xvii), of this law shall extend to 50 years, until 31 december, the fifth decade after the first publication of the work, but not after the completion of the work itself。
Law of the people's republic of china on patents
Article 42 the duration of patents for inventions is 20 years and for practical new types of patents and patent rights for visual design is 10 years, calculated from the date of application。
Article 43 the patentee shall pay an annual fee from the year in which the patent is granted。
Article 44 if the patent is terminated before the expiry of the period:
(i) failure to pay the required annual fee;
(ii) if the patentee renounces its patent by written declaration。
What are the characteristics of intellectual property rights
(1) intellectual property is an intangible property。
(2) intellectual property has an exclusive character。
(3) intellectual property has temporal characteristics。
(4) intellectual property has geographical characteristics。
(5) the acquisition of most intellectual property rights requires a statutory procedure, such as the registration of trademark rights。
It is thus clear from the full text that copyright protection is 50 years after the death of the author of the work, while patent protection is 20 years, and new appearance patent protection is 10 years and starts from the date of application。
